1. ACKNOWLEDGMENT OF ACTIVITY AND RISKS
I understand that Wonder Wheels operates a mobile play bus that provides physical play equipment and activities designed for children. I understand that participation involves inherent risks, including but not limited to: slips, falls, collisions, equipment failure, Falls, collisions with other children or equipment, sprains, cuts, broken bones or other physical injuries, misuse of equipment or equipment failure, exposure to weather, uneven ground, or environmental conditions, entry/exit on or around a parked vehicle, the presence of large groups of children and normal activity risks associated with play and potential exposure to contagious illnesses/allergens. These risks may result in serious injury, illness, or death.
I acknowledge that these risks cannot be completely eliminated without jeopardizing the essential nature of the activity, and I freely and voluntarily choose to participate (or allow my child/ward to participate) despite the risks.
2. ASSUMPTION OF RISK
I knowingly and voluntarily assume full responsibility for all risks of injury, harm, or loss arising from participation in Wonder Wheels activities,whether caused by the negligence of Wonder Wheels or otherwise, to the fullest extent permitted by North Carolina law.
3. WAIVER AND RELEASE OF LIABILITY
In consideration of participation, I, for myself and my minor child, hereby release and discharge CJ Ventures, LLC and its owners, officers, employees, agents, representatives, vendors, and affiliates (“Released Parties”) from any and all liability for injuries, losses, or damages, including those caused by ordinary negligence, arising from participation in bus activities.
This includes, but is not limited to, claims for personal injury, property damage, emotional distress, illness (including exposure to infectious diseases such as COVID-19), and any resulting legal or medical costs.
4. INDEMNIFICATION AND HOLD HARMLESS
I agree to indemnify, defend, and hold harmless Wonder Wheels from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to:
(a) my own participation (or the participation of my child/ward),
(b) any failure to follow rules or instructions, or (c) any claim brought by a third party arising from my (or my child/ward’s) actions during Wonder Wheels activities.
5. MEDICAL AUTHORIZATION
In the event of injury or illness, I authorize Wonder Wheels personnel to provide or seek emergency medical treatment for myself or my child/ward as deemed necessary and agree to be financially responsible for any costs incurred as a result.
6. RULES AND SAFETY COMPLIANCE
I agree to follow all posted rules, verbal instructions, and safety guidelines provided by Wonder Wheels staff. Failure to comply may result in removal from participation without refund.
7. SEVERABILITY
If any portion of this Agreement is held invalid under North Carolina law, the remaining provisions shall continue in full legal force and effect.
8. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of North Carolina.
